General contracting conditions

Entry into force date: 15/07/2014

1. Contracting Parties.

On behalf of, ST CONSULTORES INMOBILIARIOS SL. Registered regime mercantile of Madrid on page M-177570, VAT NUMBER. B-81/512550 registered office at calle Principe de Vergara 43, 28001 Madrid.
Natural persons or legal stability addressed to the services of ST CONSULTORES INMOBILIARIOS SL, contracted through the web site in exchange of an economical return according to what has been prepared in this document.

2. General conditions of contracting the services offered.

In the present general conditions of hiring our services, the client may consult the conditions of provision of services offered and must accept it to continue the contracting procedure.
The fact that the client accepts these conditions does not imply that ST CONSULTORES INMOBILIARIOS SL (also ST CONSULTORES) accepts it automatically. The contract will be understood as done, the moment ST CONSULTORES checks your down payments. (see price rates on part 5 of this same document)
The electronic document in which we formalize our agreement will be securly filed on our data base, being this the original contract. In case of disagreement between the client´s copy and the filed copy in the data base server of ST CONSULTORES, the last will have priority.
ST CONSULTORES will send to the client email adress according to the required information, containing an official and formalized contract. This email will have a receipt of the price and acceptance of the order by ST CONSULTORES.
In case of not verifying the payment of the services, we would understand that the client has given up the order.
ST CONSULTORES reserves its right to modify the general conditions of the contract.
If any modifications are made, they will be published on web site and will be carried out from that moment.

3. Services provided

ST CONSULTORES offers the client through our web site the possibility to seek reports called ”Building Survey” and “Condition Report”, both for the internal use of our clients.
All these services are for use in properties based in Spanish territory.
In the following documents, we will define the reach of our services and the limits of our working conditions which form an essential part of our contract.

ST CONSULTORES are committed to provide with professional procedures the services provided without unjustified delayment. For this, we will put all the complementary means needed or if needed for a correct performance of the services.

4. General features of service provision.

4.1- Register of order.
To carry out the order, first of all the client should fill in an electronic form situated on our web site. . It should be filled in with contact information and invoicing, also the type of report you would like to order and information about the contact to carry out our visits.
Once the client has filled in the form, the client must accept the general conditions of the contract, private policy and general conditions used on our web site.
Next, the application shows the client a summary of the services requested and the cost of it, where his/her name appears, email address, passport number, invoice address, and the cost including VAT.
In this moment of the process the client can cancel his application or continue with the process.
If you decide to continue, you must proceed to the payment of the amount mentioned.

4.2- Carry out your service payment.

The payment of these services is necessary to begin to provide the service.
This payment can be done with credit card or debit, or any other means of payment set up on the web site.
Currently on our web site we are working with:

  • PayPal
  • Credit card payment.

In either one of these options selected, the system will forward it automatically to a POS.

4.3- Sending a formalization of the contract to a client.

Once you have made the payment, ST CONSULTORES will show the client on screen where it will indicate that the payment has been made successfully. Lastly, the electronic document where the contract has been made official will be sent via email to the address the client indicated on the electronic form and finalizing to execute the order. This will be filed in ST CONSULTORES.

4.4- Rejecting an order through ST CONSULTORES.

ST CONSULTORES can reject an order if there is a motive. This will be notified to the client in a period of 24 hours from the request. From this moment we will refund the expenses received.

4.5.- To carry out our visits.

To carry out our visits by the technical department, a technician will get in contact with the agent or person of contact who has been assigned to arrange the date of meeting to the Real Estate or property in a period, no longer than 24 hours on labour days.

4.6.- Carry out the work.

Once the visit has been made and after the client has brought in the necessary documents, a survey will be made in a period no longer than 72 hours from the date of inspection.

5. Rates

Taken into consideration to carry out the services which have been described, we have established 4 different prices depending on the total surface built of the home.

  • Condition Report. House less than 250 m2 total floor area. 350 €, VAT not included. 423,50 € VAT included.
  • Condition Report. House more than 250 m2 total floor area. 450 €, VAT not included. 544,50 € VAT included.
  • Building Survey. House less than 250 m2 total floor area. 450 €, VAT not included. 544,50 € VAT included.
  • Buildinf Survey. House more than 250 m2 total floor area. 600 €, VAT not included. 726 € VAT included.

6. Presenting reports

The report will be sent from the account in English language to the email address provided by the client and a formal invoice will be sent with the final quotation of the service. In case of errors or omissions found in the report, a new report will be sent modifying the last.

7. Use of the report-Privacy

Any document, report or analysis emitted by ST CONSULTORES lead by the contractual relationship will have a privacy policy and only for the use of clients.
All the documents and data which ST CONSULTORES has access to as a consequence of offering our services, will be considered confidential, so that no information will be revealed to anybody apart from this relationship. These terms will be maintained by will of law.8.

8. Customer Service

As a regulated RICS firm, we have in place a Complaints Handling Procedure (CHP), and a Complaints log, meeting the regulatory requirements. Our CHP has two stages:
Stage One. It gives our firm the opportunity to review and consider your complaint in full. Our firm will try to resolve your complaint to your satisfaction.
If you have spoken to us about your complaint, please put the details of your complaint in writing. We ask that you put your complaint in writing to make sure that we have a full understanding of the reasons for your complaint. Please send your written complaint to:

We will consider your complaint as quickly as possible, and will acknowledge receipt of your complaint within 7 days. If we are not able to give you a full response, we will update you within 28 days.
If you are not happy with our response, you will have the opportunity to take your complaint to stage two.
Stage Two. It gives you the client, the opportunity to have your complaint reviewed and considered by an independent redress provider, approved by RICS.
If we are unable to agree on how to resolve your complaint then you have the opportunity to take your complaint to an independent redress provider, as approved by RICS Regulatory Board. We have chosen to use the following redress providers:

9. Legislation. Jurisdiction.

The obligations that will take place to contracting our service, will govern and be interpreted by Spanish legislation, which will be applied directly to what is published on this page
Both parties can use legal methods as much demands they have using court or trials in the city of Madrid.
